A BILL TO BE ENTITLED
AN ACT
relating to notification of the state representatives and state
senators of a proceeding to impose on a county with a population of
less than 75,000 a penalty or fine for an alleged environmental
violation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 7, Water Code, is amended
by adding Section 7.0551 to read as follows:
Sec. 7.0551. NOTICE TO STATE SENATORS AND STATE
REPRESENTATIVES. If the executive director is required under
Section 7.055 to give written notice of a report of a violation for
an alleged violation by a county with a population of less than
75,000, the executive director shall give the same written notice
to the state senators and the state representatives for the
districts in which the county is located.
SECTION 2. Subchapter D, Chapter 7, Water Code, is amended
by adding Section 7.1065 to read as follows:
Sec. 7.1065. NOTICE TO STATE SENATORS AND STATE
REPRESENTATIVES. If a civil suit is filed under Section 7.105 to
recover a penalty for an alleged violation by a county with a
population of less than 75,000, the executive director, not later
than the 10th day after the date the suit is filed, shall give
written notice of the suit and of the relief or penalty sought to
the state senators and the state representatives for the districts
in which the county is located.
SECTION 3. (a) This Act takes effect September 1, 2003.
(b) The changes in law made by Sections 7.0551 and 7.1065,
Water Code, as added by this Act, apply only to:
(1) a violation for which a report of a violation is
issued under Section 7.054, Water Code, on or after September 1,
2003; and
(2) a suit to recover a civil penalty under Section
7.105, Water Code, that is instituted on or after September 1, 2003.
