A BILL TO BE ENTITLED

AN ACT

relating to State Board of Education rules concerning textbooks and 
to adoption of textbooks by the board.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 31.003, Education Code, is amended to 
read as follows:   
	Sec. 31.003.  RULES.  The State Board of Education shall
[may] adopt rules, consistent with this chapter, for the adoption, 
requisition, distribution, care, use, and disposal of textbooks.  
Rules adopted concerning the adoption of textbooks must ensure that 
each textbook on a conforming or nonconforming list complies with 
Section 28.002(h) and with this chapter.
	SECTION 2.  Section 31.024, Education Code, is amended by 
adding Subsection (c) to read as follows:
	(c)  By majority vote, the board shall determine whether a 
textbook submitted for placement on a conforming or nonconforming 
list complies with Section 28.002(h) and shall reject under 
Subsection (a)(2) a textbook that does not comply with Section 
28.002(h) and with this chapter.
	SECTION 3.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
