A BILL TO BE ENTITLED
AN ACT
relating to requiring a business entity that is awarded a state
contract to notify the state about investments in businesses
involved with obscenity.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 2155, Government Code, is
amended by adding Section 2155.006 to read as follows:
Sec. 2155.006. NOTICE OF CERTAIN INVESTMENTS TO GOVERNOR,
LEGISLATORS, AND COMMISSION. (a) In this section, "material,"
"obscene," and "performance" have the meanings assigned by Section
43.21, Penal Code.
(b) A business entity that is awarded a state contract to
provide goods or services shall notify the commission, each member
of the legislature, and the governor in writing of any financial
investment the entity has in a business involved with the
distribution or sale of obscene material or performances. The
business entity must provide the notice not later than the 30th day
after the date the entity is awarded the state contract or not later
than the 30th day after the date of making the financial investment,
as applicable.
SECTION 2. This Act takes effect September 1, 2003.
