A BILL TO BE ENTITLED
AN ACT
relating to the landward boundary of the public beach when natural dune vegetation is planted and becomes established at a beach renourishment project. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 61.017, Natural Resources Code, is amended by adding Subsection (e) to read as follows: Section 61.017. Line of Vegetation Unaffected by Certain Conditions (e) Notwithstanding subsections (a) and (b) of this section, a beach renourishment project which entails planting of native dune vegetation can be undertaken to restore the public beach and re-establish the line of vegetation. Such beach renourishment projects for the purposes of this subsection can only be undertaken by federal, state, or local government entities, or by a private entity in partnership with one or more government entities. Sand used in such beach renourishment projects shall have the same grain size and mineralogy as the surrounding beach area. Upon completion of the renourishment project and re-establishment of the planted native vegetation, the landward boundary of the public beach will be the line of newly established planted vegetation.
