A BILL TO BE ENTITLED
AN ACT
relating to the authority of a public school teacher over student grades. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 28, Education Code, is amended by adding Section 28.027 to read as follows: Sec. 28.027. GRADING OF STUDENTS. (a) A school district may not require a teacher to change a grade given by the teacher to a student unless the board of trustees or its designee determines that the grade was given erroneously, arbitrarily, or capriciously or was given in conflict with the district's grading policy. (b) A determination of the board of trustees or its designee under this section is final and may not be appealed, except that the determination may be appealed to the commissioner or the commissioner's designee in the manner provided by Section 33.081(g) if the issues presented meet the requirements of that subsection. SECTION 2. This Act applies beginning with the 2003-2004 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
