A BILL TO BE ENTITLED
AN ACT
relating to the establishment of the offense of performing a
medical procedure while under the influence of drugs or alcohol.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 165, Occupations Code, is
amended by adding Section 165.1535 to read as follows:
Sec. 165.1535. PERFORMING MEDICAL PROCEDURE WHILE
INTOXICATED. (a) In this section, "intoxicated" has the meaning
assigned by Section 49.01, Penal Code.
(b) A person commits an offense if the person is licensed or
regulated under this subtitle and performs a medical procedure
while intoxicated.
(c) An offense under this section is a state jail felony.
SECTION 2. This Act takes effect September 1, 2003.
