A BILL TO BE ENTITLED
AN ACT
relating to a study of the regulation, design, planning, construction, installation, operation, maintenance, and inspection of on-site sewage disposal systems. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The Texas Commission on Environmental Quality shall conduct a study of the regulation, design, planning, construction, installation, operation, maintenance, and inspection of on-site sewage disposal systems. SECTION 2. The Texas Commission on Environmental Quality shall appoint an advisory committee to assist the commission in conducting the study required by Section 1 of this Act. The advisory committee must consist of not more than 12 individuals knowledgeable about and affected by the regulation of on-site sewage disposal systems and must include designers, manufacturers, installers, regulators on the state and local levels, builders of homes, mobile home dealers, and consumers. Advisory committee members may not receive compensation for their services. SECTION 3. The Texas Commission on Environmental Quality shall issue a report on the study to the governor, the lieutenant governor, and the speaker of the house of representatives not later than September 1, 2004. The study must include recommendations for measures to eliminate or prevent environmental and health hazards related to on-site sewage disposal system regulation, design, planning, construction, installation, operation, maintenance, and inspection. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
