A BILL TO BE ENTITLED
AN ACT
relating to the performance review of peace officers enforcing
traffic laws.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 720.002(a), Transportation Code, is
amended to read as follows:
(a) A political subdivision or an agency of this state may
not establish or maintain, formally or informally, a plan to
evaluate, promote, compensate, or discipline:
(1) a peace officer according to the officer's:
(A) issuance of a predetermined, average, or
specified number or percentage of any type or combination of types
of traffic citations or stops; or
(B) making a predetermined, average, or
specified number or percentage of any type or combination of types
of arrests resulting from the enforcement of laws or ordinances
regulating traffic; or
(2) a justice of the peace or a judge of a county
court, statutory county court, municipal court, or municipal court
of record according to the amount of money the justice or judge
collects from persons convicted of a traffic offense.
SECTION 2. This Act takes effect September 1, 2003.
