A BILL TO BE ENTITLED

AN ACT

relating to payments to certain grandparents who provide care for 
children whose parents are deceased.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 264, Family Code, is 
amended by adding Section 264.113 to read as follows:
	Sec. 264.113.  PAYMENTS TO CERTAIN GRANDPARENTS FOR 
PROVIDING CARE FOR A CHILD.  (a)  The department shall pay to the 
grandparent of a child who is not otherwise eligible for foster care 
payments an amount equal to the amount the department would pay 
under Section 264.101 for foster care, including medical care, for 
a child under the placement or care of the department if:
		(1)  both parents of the child are deceased; and                       
		(2)  the child is in the care of the grandparent and no 
other conservator or guardian has been appointed for the child.
	(b)  The department by rule shall establish application 
procedures and proof of eligibility requirements for receipt of 
payments under this section.
	SECTION 2.  This Act takes effect September 1, 2003.
