A BILL TO BE ENTITLED
AN ACT
relating to deductions from the salaries of school district employees for professional dues. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 22.001, Education Code, is amended by amending Subsection (b) and adding Subsections (a-1), (d), and (e) to read as follows: (a-1) A school district may adopt one or more forms to be used to file a request under Subsection (a)(1) or to provide information under Subsection (a)(2). (b) The district shall deduct the total amount of the fees or dues for a year in equal amounts per pay period for the number of periods specified by the employee. Except as provided by Subsection (e), the [The] deductions shall be made until the employee requests in writing that the deductions be discontinued. (d) A school district may not impose conditions or requirements, other than those authorized or required by this section or other law, in connection with making a deduction from a district employee's salary for membership fees or dues to a professional organization. (e) Not later than December 1 of each year, each professional organization that has one or more members who have an amount deducted from the member's school district salary for membership fees or dues to the organization shall provide each of those members a notice that states the total amount of fees and dues to the organization to be deducted from the employee's salary for that year. The notice also must inform the employee of the manner in which the deductions may be discontinued and provide a form for that purpose. A district may not at any time make any further deductions from a district employee's salary for membership fees or dues to a professional organization that has failed to make a good faith effort to comply with this subsection. A district shall make a determination of whether a professional organization has failed to make a good faith effort to comply with this subsection in accordance with a policy adopted by the board of trustees of the district. SECTION 2. This Act takes effect September 1, 2003.
