A BILL TO BE ENTITLED
AN ACT
relating to allowing a governmental body to conduct a
self-evaluation of the governmental body's performance in a closed
meeting.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 551.074, Government Code, is amended to
read as follows:
Sec. 551.074. PERSONNEL MATTERS; SELF-EVALUATION; CLOSED
MEETING. (a) This chapter does not require a governmental body to
conduct an open meeting:
(1) to deliberate the appointment, employment,
evaluation, reassignment, duties, discipline, or dismissal of one
or more [a] public officers [officer] or of a public employee; or
(2) to hear a complaint or charge against an officer or
employee.
(b) Subsection (a) does not apply if an [the] officer or
employee who is the subject of the deliberation or hearing requests
a public hearing.
(c) This chapter does not require a governmental body to
conduct an open meeting to engage in a self-evaluation of the
governmental body's performance as a whole.
SECTION 2. This Act takes effect September 1, 2003.
