A BILL TO BE ENTITLED
AN ACT
relating to the performance of asbestos surveys. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter F, Chapter 1954, Occupations Code, is amended by adding Section 1954.260 to read as follows: Sec. 1954.260. DURATION OF ASBESTOS SURVEY. An asbestos survey performed for a public building as required by this chapter and any other law is valid if the survey was performed in compliance with the laws in effect at the time the survey was completed and the survey identifies any asbestos-containing building material, the location of that material, and any other asbestos condition in the building. Any renovation, construction, or other activity for which an asbestos survey is required shall be conducted without the requirement of obtaining a new asbestos survey if a valid asbestos survey exists. SECTION 2. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act applies only to an asbestos survey performed by a person licensed under Chapter 1954, Occupations Code, as amended by this Act, on or after the effective date of this Act. An asbestos survey performed before the effective date of this Act is governed by the law in effect on the date the survey was performed, and the former law is continued in effect for that purpose.
