A BILL TO BE ENTITLED

AN ACT

relating to attendance by the superintendent of a school district 
at a closed meeting of the board of trustees of the district.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 11.201, Education Code, is amended by 
adding Subsection (e) to read as follows:
	(e)  In this subsection, "closed meeting" has the meaning 
assigned by Section 551.001, Government Code.  A contract between 
the board of trustees of an independent school district and the 
superintendent may:
		(1)  provide that the superintendent is entitled to 
attend a closed meeting of the board; and
		(2)  include any reasonable limitation on the 
superintendent's right to attend a closed meeting.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
