A BILL TO BE ENTITLED
AN ACT
relating to a preconstruction termite treatment fee program.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 1951.002, Occupations Code, is amended
by adding Subdivision (17) to read as follows:
(17) "Preconstruction termite treatment" means the
treatment of soil with a liquid termiticide, installation of a
physical or chemical barrier, installation of a baiting system, or
on-site treatment of wooden structural members of a structure
before or during initial building construction, remodeling, or
addition for the prevention of subterranean termites, including
Formosan termites.
SECTION 2. Subchapter H, Chapter 1951, Occupations Code, is
amended by adding Section 1951.354 to read as follows:
Sec. 1951.354. PRECONSTRUCTION TERMITE TREATMENT FEE. The
board shall charge a fee of not less than $10 or more than $20, as
determined by the board, payable before treatment commences for
each preconstruction termite treatment performed by a business
licensed by the board. For purposes of this section, only one fee
shall be collected for treatment for a single building even though
treatment may occur on more than one day.
SECTION 3. This Act takes effect September 1, 2003. The
Texas Structural Pest Control Board shall adopt standards relating
to collection of fees and administration of this Act not later than
October 1, 2003.
