A BILL TO BE ENTITLED

AN ACT

relating to the venue in the prosecution of the offense of 
misapplication of trust funds.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 13, Code of Criminal Procedure, is 
amended by adding Article 13.28 to read as follows:
	Art. 13.28.  MISAPPLICATION OF TRUST FUNDS.  An offense 
under Section 162.031, Property Code, may be prosecuted in the 
county in which the:
		(1)  trust funds were diverted or received; or                         
		(2)  improvement to specific real property was to be 
performed.      
	SECTION 2.  (a)  This Act takes effect September 1, 2003.                      
	(b)  The change in law made by this Act applies only to an 
offense committed on or after the effective date of this Act.  An 
offense committed before the effective date of this Act is covered 
by the law in effect when the offense was committed, and the former 
law is continued in effect for that purpose.  For purposes of this 
subsection, an offense was committed before the effective date of 
this Act if any element of the offense was committed before that 
date.
