A BILL TO BE ENTITLED
AN ACT
relating to the appointment of board members to cultural arts councils in certain populous counties and municipalities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subtitle C, Title 10, Local Government Code, is amended by adding Chapter 336 to read as follows:
CHAPTER 336. CULTURAL ARTS COUNCILS
SUBCHAPTER A. GENERAL PROVISIONS
Sec. 336.001. DEFINITION. In this chapter, "cultural arts council" means a nonprofit organization created to promote the development of cultural and art programs in an area. Sec. 336.002. APPLICABILITY. This chapter applies only to a cultural arts council that: (1) is located in: (A) a municipality with a population of 1.5 million or more; or (B) a county with a population of 3.3 million or more; (2) receives money for its programs from the municipality, the county, the federal government, or the state, including the Texas Commission on the Arts; and (3) is exempt from taxation under Section 501(c)(3), Internal Revenue Code of 1986.

SUBCHAPTER B. POWERS AND DUTIES
Sec. 336.051. BOARD REQUIREMENTS. To be eligible to receive money from the state or a political subdivision of the state, the board of directors of a cultural arts council must have at least three members appointed jointly by different members of the legislature whose districts are located at least in part in the municipality or county in which the council is located or the area that the council serves. SECTION 2. This Act takes effect December 1, 2003.
