A BILL TO BE ENTITLED
AN ACT
relating to reimbursing classroom teachers for personal funds
expended on classroom supplies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 22, Education Code, is
amended by adding Section 22.007 to read as follows:
Sec. 22.007. CLASSROOM SUPPLY REIMBURSEMENT. (a) From
funds appropriated for this purpose, the commissioner shall
establish a program under which each classroom teacher that expends
personal funds for classroom supplies shall be reimbursed from
state funds provided to school districts in the form of matching
funds.
(b) Funds provided under the program shall be used solely
for the benefit of students and the use of funds shall be at the
discretion of the classroom teacher. The commissioner shall
establish rules for the allocation of funds within a school
district. Funds provided under the program may not be used to
replace local funds being used for the same purpose.
(c) The commissioner shall identify state and federal funds
eligible for use under this section, including funds subject to the
Education Flexibility Partnership Act of 1999 (200 U.S.C. Section
5891a et seq.), as amended, as well as consolidated administrative
funds.
SECTION 2. This Act applies beginning with the 2003-2004
school year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
