A BILL TO BE ENTITLED
AN ACT
relating to court ordered payments by persons on community supervision. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 42, Section 42.12, Subsection 11 of the Code of Criminal Procedure, is amended by adding Subsections (i), (j), and (k) to read as follows: (g) A judge who grants community supervision to a person may require the person to make one payment in an amount not to exceed $50 to a children's advocacy center established under Subchapter E, Chapter 264, Family Code, if the person is charged with or convicted of an offense under Section 21.11 or 22.011(a)(2), Penal Code. (h) If a judge grants community supervision to a person convicted of an offense under Title 5, Penal Code, that the court determines involves family violence, the judge may require the person to make one payment in an amount not to exceed $100 to a family violence shelter center that receives state or federal funds and that serves the county in which the court is located. In this subsection, "family violence" has the meaning assigned by Section 71.004, Family Code, and "family violence shelter center" has the meaning assigned by Section 51.002, Human Resources Code. (i) If a judge grants community supervision to a person convicted of an offense involving an offense or an inchoate offense against a person or an animal as defined in Title 5, Title 8, Title 9, or Title 10 of the Texas Penal Code, the court may require the person to make one payment in the amount of $50 to a pediatric and adolescent hospital as defined by Section 241.003 of the Texas Health and Safety Code and serves the county in which the court is located. (j) If a judge grants community supervision to a person convicted of an offense involving injury to person or an animal as defined in Title 5, Title 6, Title 8, Title 9, or Title 10 of the Texas Penal Code, the court may require the person to make one payment in the amount of $50 to a charitable organization that is operated exclusively for prevention of cruelty to animals as defined in Section 84.003 of the Texas Civil Practice and Remedies Code and serves the county in which the court is located. (k) If a judge grants community supervision to a person convicted of an offense or an inchoate offense against property as defined in Title 7 of the Penal Code, the judge may require the person to make one payment in an amount not to exceed $100 to a charitable organization as defined in Section 84.003 of the Texas Civil Practice and Remedies Code, including Habitat for Humanity. SECTION 2. This Act takes effect September 1, 2002.
