A BILL TO BE ENTITLED

AN ACT

relating to a review of the operations of the Windham School 
District by the Sunset Advisory Commission.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 19, Education Code, is amended by adding 
Section 19.0021 to read as follows:
	Sec. 19.0021.  SUNSET REVIEW.  (a) The Sunset Advisory 
Commission shall review the operations of the Windham School 
District.  In the review, the commission shall evaluate:
		(1)  the extent to which the district achieves the 
goals stated in Section 19.003; and
		(2)  whether money from the foundation school fund, 
appropriated funds, and gifts and grants are being used efficiently 
to achieve the goals stated in Section 19.003.
	(b)  Before January 1, 2005, the Sunset Advisory Commission 
shall make recommendations to the legislature about whether the 
Windham School District should be continued.
	(c)  Unless continued by the legislature, this chapter 
expires September 1, 2005.
	SECTION 2.  If by the terms of Section 19.0021(c), Education 
Code, as added by this Act, Chapter 19, Education Code, expires on 
September 1, 2005, on that date:
		(1)  all powers, duties, functions, and activities 
performed by the Windham School District are transferred to the 
Texas Department of Criminal Justice;
		(2)  all employees of the Windham School District 
become employees of the Texas Department of Criminal Justice, to be 
assigned duties by the department;
		(3)  a rule, form, order, or procedure adopted by the 
Windham School District is a rule, form, order, or procedure of the 
Texas Department of Criminal Justice and remains in effect until 
changed by the department;
		(4)  a reference in law to the Windham School District 
means the Texas Department of Criminal Justice;
		(5)  all obligations, rights, and contracts of the 
Windham School District are transferred to the Texas Department of 
Criminal Justice; and
		(6)  all property, including records and money, in the 
custody of the Windham School District and all funds appropriated 
by the legislature for the district shall be transferred to the 
Texas Department of Criminal Justice.
	SECTION 3.  This Act takes effect September 1, 2003.
