A BILL TO BE ENTITLED
AN ACT
relating to disbursements from the universal service fund.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 56.024, Utilities Code, is amended by
amending Subsection (b) and adding Subsections (c), (d), and (e) to
read as follows:
(b) A report or information is confidential and not subject
to disclosure under Chapter 552, Government Code, except as
provided by Subsections (c) and (d) and rules adopted under those
subsections.
(c) The commission by rule shall provide for public
disclosure of information regarding a revenue requirement showing
under Section 56.026. A revenue requirement showing is public
information subject to Chapter 552, Government Code.
(d) The commission by rule shall require a
telecommunications provider that receives a disbursement from the
universal service fund to provide specific information regarding
the expenditure of the disbursement. Information regarding the
expenditure of money from the universal service fund is public
information subject to Chapter 552, Government Code.
(e) The commission shall compile information regarding
revenue requirement showings under this chapter and expenditures of
money from the universal service fund to facilitate public access
to the information and understanding of the purposes of the
expenditures.
SECTION 2. Section 56.026(a), Utilities Code, is amended to
read as follows:
(a) The commission by rule shall require a [A] revenue
requirement showing [is not required] for a disbursement from the
universal service fund under this subchapter.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
