A BILL TO BE ENTITLED
AN ACT
relating to requiring certain municipalities and counties to publish public notices in Spanish-language newspapers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 51, Local Government Code, is amended by adding Section 51.004 to read as follows: Sec. 51.004. PUBLICATION OF PUBLIC NOTICE IN SPANISH-LANGUAGE NEWSPAPER. (a) This section applies only to a municipality any portion of which is located in a county in which more than 50 percent of the population is of Hispanic origin. (b) In this section, "public notice" means any notice that a municipality must provide to the general public under Chapter 551, Government Code, or other law. (c) A municipality shall publish a public notice in Spanish in a newspaper of general circulation in each county in which the municipality is located that is printed in Spanish, if there is a newspaper of general circulation in the county printed in Spanish. (d) Notice published under this section is in addition to notice required by other law. SECTION 2. Chapter 89, Local Government Code, is amended by adding Section 89.007 to read as follows: Sec. 89.007. PUBLICATION OF PUBLIC NOTICE IN SPANISH-LANGUAGE NEWSPAPER. (a) This section applies only to a county in which more than 50 percent of the population is of Hispanic origin. (b) In this section, "public notice" means any notice that a county must provide to the general public under Chapter 551, Government Code, or other law. (c) A county shall publish a public notice in Spanish in a newspaper of general circulation in the county that is printed in Spanish, if there is a newspaper of general circulation in the county printed in Spanish. (d) Notice published under this section is in addition to notice required by other law. SECTION 3. This Act takes effect September 1, 2003.
