A BILL TO BE ENTITLED
AN ACT
relating to an administrative review process for child support payments. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 234, Family Code, is amended by adding Subchapter C to read as follows:
SUBCHAPTER C. ADMINISTRATIVE REVIEW OF CHILD SUPPORT PAYMENTS
Sec. 234.151. ADMINISTRATIVE REVIEW. (a) The Title IV-D agency shall establish and operate an administrative review process to review child support payment records maintained by a local registry and the state disbursement unit on the request of an obligor. (b) In establishing the process, the Title IV-D agency must provide procedures by which: (1) an obligor who alleges that the local registry or state disbursement unit has incorrectly collected, credited, or disbursed a child support payment may request a review of the obligor's child support payment records; and (2) the Title IV-D agency will conduct the review, including providing deadlines for completing the review process and procedures for correcting errors in the obligor's child support payment records, if any. (c) An obligor is not entitled to an administrative review of the obligor's child support payment records more frequently than once each three-year period. SECTION 2. The Title IV-D agency shall establish the child support payment administrative review process required by Subchapter C, Chapter 234, Family Code, as added by this Act, not later than January 1, 2004. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
