A BILL TO BE ENTITLED
AN ACT
relating to changing the titles of the heads of the staff of the
Texas Alcoholic Beverage Commission to executive director and
deputy executive director.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 5.11, Alcoholic Beverage Code, is
amended to read as follows:
Sec. 5.11. EXECUTIVE DIRECTOR [ADMINISTRATOR]. (a) The
commission shall appoint an executive director [administrator] to
serve at its will and, subject to its supervision, administer this
code. Unless the commission orders otherwise, the executive
director [administrator] shall be manager, secretary, and
custodian of all records. The executive director [administrator]
shall devote the executive director's [his] entire time to the
office and shall receive a salary as appropriated by the
legislature. The executive director [administrator] shall execute
a bond in the sum of $10,000, payable to the state, and conditioned
as the commission requires.
(b) A reference in this code or another law to the
administrator of the commission means the executive director.
SECTION 2. Section 5.13, Alcoholic Beverage Code, is
amended to read as follows:
Sec. 5.13. DEPUTY EXECUTIVE DIRECTOR [ASSISTANT
ADMINISTRATOR]. The executive director [administrator] shall
appoint a deputy executive director [an assistant administrator].
The deputy executive director [assistant administrator] must meet
the same qualifications as the executive director [administrator].
The deputy executive director [assisant administrator] shall take
the constitutional oath of office and make a bond in the same amount
and on the same conditions as the executive director's
[administrator's] bond. In the absence of the executive director
[administrator], or in case of the executive director's [his]
inability to act, the deputy executive director [assistant
administrator] shall perform the duties conferred on the executive
director [administrator] by law or delegated to the executive
director [administrator] by the commission. If there is a vacancy
in the office of executive director [administrator], the deputy
executive director [assistant administrator] shall perform the
duties of the executive director [administrator] until an executive
director [administrator] has been appointed by the commission. At
other times the deputy executive director [he] shall perform those
duties and have those functions, powers, and authority as may be
delegated to the deputy executive director [him] by the executive
director [administrator].
SECTION 3. This Act takes effect September 1, 2003.
