A BILL TO BE ENTITLED

AN ACT

relating to the standard operating procedures of certain fire 
departments for fighting structure fires.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 419.046(d), Government Code, is amended 
to read as follows:
	(d)  This subsection applies only to a fire department of a 
local government with a population of 350,000 or more.  The standard 
operating procedures for structure fires shall comply with the 
Occupational Safety and Health Administration's Final Rule, 29 
C.F.R. Section 1910.134(g)(4), procedures for interior structural 
fire fighting of July 1, 1998.
	SECTION 2.   This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
