A BILL TO BE ENTITLED
AN ACT
relating to the care of a child taken into possession by a
governmental entity without a court order.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 262, Family Code, is
amended by adding Section 262.009 to read as follows:
Sec. 262.009. TEMPORARY CARE OF CHILD TAKEN INTO
POSSESSION. An employee of or volunteer with a law enforcement
agency who successfully completes a background and criminal history
check approved by the Department of Protective and Regulatory
Services may assist a law enforcement officer or juvenile probation
officer with the temporary care of a child who is taken into
possession by a governmental entity without a court order under
this chapter until further arrangements regarding the custody of
the child can be made.
SECTION 2. Section 262.009, Family Code, as added by this
Act, applies to the temporary care of a child in the possession of a
governmental entity on or after the effective date of this Act
regardless of whether the child was taken into possession by the
governmental entity before, on, or after the effective date of this
Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
