A BILL TO BE ENTITLED

AN ACT

relating to the eligibility of a candidate to assist a voter.                 
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 64.032, Election Code, is amended by 
amending Subsection (c) and adding Subsection (e) to read as 
follows:
	(c)  Except as provided by Subsection (e), on [On] the 
voter's request, the voter may be assisted by any person selected by 
the voter other than a candidate on the ballot, the voter's 
employer, an agent of the voter's employer, or an officer or agent 
of a labor union to which the voter belongs.
	(e)  A county clerk may assist a voter in an election for 
which the county clerk is a candidate or in another election held on 
the same day as an election for which the county clerk is a 
candidate, but only if:
		(1)  the assistance of the county clerk is necessary to 
comply with Subsection (a); or
		(2)  no other election officer is available to assist 
the voter and the voter selects the county clerk to assist the voter 
under Subsection (c).
	SECTION 2.  This Act takes effect September 1, 2003.
