A BILL TO BE ENTITLED
AN ACT
relating to an exemption from The Texas Engineering Practice Act for certain public works. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 1001.053, Occupations Code, is amended to read as follows: Sec. 1001.053. PUBLIC WORKS. The following work is exempt from this chapter: (1) a public work that involves [structural,] electrical[,] or mechanical engineering, if the contemplated expense for the completed project is $8,000 or less; (2) a public work that does not involve [structural,] electrical[,] or mechanical engineering, if the contemplated expense for the completed project is $20,000 or less; or (3) road maintenance or improvement undertaken by the commissioners court of a county. SECTION 2. This Act takes effect June 1, 2003, if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for effect on that date, this Act takes effect September 1, 2003.
