A BILL TO BE ENTITLED
AN ACT
relating to the size of containers for certain alcoholic beverages. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 101.44, Alcoholic Beverage Code, is amended to read as follows: Sec. 101.44. CONTAINERS OF BEER: CAPACITIES. A [No] person may not possess, sell, or transport [any] beer in a container [except in containers] having a capacity of less than four [of one barrel, one-half barrel, one-quarter barrel, or one-eighth barrel, or in bottles or cans having a capacity of 32, 24, 16, 12, 8, or 7] fluid ounces. SECTION 2. (a) This Act takes effect September 1, 2003, and applies only to an offense committed on or after the effective date of this Act. (b) An offense committed before the effective date of this Act is governed by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. (c) For the purposes of this section, an offense is committed before the effective date of this Act if any element of the offense occurs before that date.
