A BILL TO BE ENTITLED
AN ACT
relating to the creation of a Kickapoo deer hunting license. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 42.001(1), Parks and Wildlife Code, is amended to read as follows: (1) "Resident" means: (A) an individual who has resided continuously in this state for more than six months immediately before applying for a hunting license; (B) a member of the United States armed forces on active duty; (C) a dependent of a member of the United States armed forces on active duty; [or] (D) a member of any other category of individuals that the commission by regulation designates as residents; or (E) a member of the Kickapoo Traditional Tribe of Texas. SECTION 2. Chapter 42, Parks and Wildlife Code, is amended by adding Sections 42.015 and 42.016 to read as follows: Sec. 42.015. KICKAPOO DEER HUNTING LICENSE. (a) The department shall issue a member of the Kickapoo Traditional Tribe of Texas a hunting license that permits the license holder to hunt deer in this state at any time of the year. (b) The acquisition of a Kickapoo deer hunting license does not authorize a member of the Kickapoo Traditional Tribe of Texas to hunt deer by any means not authorized by this code. (c) The acquisition of a Kickapoo deer hunting license does not authorize a member of the Kickapoo Traditional Tribe of Texas to hunt any animal, other than deer: (1) without having acquired a license or other permit required by this code; or (2) at any time or by any means not otherwise authorized by this code. Sec. 42.016. KICKAPOO DEER HUNTING LICENSE FEE. The fee for a Kickapoo hunting license is $8 or an amount set by the commission, whichever amount is greater, but not to exceed $75. SECTION 3. This Act takes effect September 1, 2003.
