A BILL TO BE ENTITLED
AN ACT
relating to the certification of maximum medical improvement and the impairment rating assigned to an employee in a claim for workers' compensation benefits. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 408.123, Labor Code, is amended by adding Subsection (d) to read as follows: (d) The Commission shall adopt a rule under which the first certification of maximum medical improvement and the resulting impairment rating assigned to an employee is final if the certification or impairment rating is not disputed within a time frame determined by Commission rule. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act take effect September 1, 2003.
