A BILL TO BE ENTITLED
AN ACT
relating to the re-enrollment of certain students who are expelled from a public school. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 37, Education Code, is amended by adding Section 37.0071 to read as follows: Sec. 37.0071. RE-ENROLLMENT OF CERTAIN EXPELLED STUDENTS. Except as provided by Section 37.007(e), a school that expels a student under this subchapter must allow the student to re-enroll in the school if: (1) the student enrolls in an open-enrollment charter school following the expulsion; and (2) the charter school discontinues operations for any reason. SECTION 2. This Act applies beginning with the 2003-2004 school year, and applies to any student who is expelled from a public school under Subchapter A, Chapter 37, Education Code, as amended by this Act, regardless of the date the student is expelled. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
