A BILL TO BE ENTITLED
AN ACT
relating to the placement of electronic monitoring devices in the rooms of certain residents in assisted living facilities. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 247, Health and Safety Code, is amended by adding Section 247.0295 to read as follows: Sec. 247.0295. ELECTRONIC MONITORING FOR PERSONS WITH ALZHEIMER'S DISEASE. (a) An assisted living facility that serves a resident who has Alzheimer's disease or a related disorder shall provide a family member of the resident the opportunity to place an electronic monitoring device in the resident's room, subject to rules adopted by the board. In developing the rules, the board may consider Subchapter R, Chapter 242. (b) A family member who places an electronic monitoring device in the room of a resident is responsible for the cost of the device. SECTION 2. The Texas Board of Human Services shall adopt the rules required by Section 247.0295, Health and Safety Code, as added by this Act, not later than January 1, 2004. SECTION 3. This Act takes effect September 1, 2003.
