A BILL TO BE ENTITLED
AN ACT
relating to allowing certain early voting polling places to serve as election day polling places. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter A, Chapter 43, Election Code, is amended by adding Section 43.007 to read as follows: Sec. 43.007. ADDITIONAL POLLING PLACES. (a) The authority conducting an election shall establish an additional polling place at the location of each branch early voting polling place, other than a moveable temporary branch early voting polling place, used in the election if the authority: (1) conducts the election using a direct recording electronic voting machine; and (2) uses an instant electronic system at each polling place to verify whether a voter has voted in an election. (b) A polling place established under this section must enable a voter of any precinct in the election to cast a ballot. (c) The secretary of state must approve a system to be used under Subsection (a)(2). SECTION 2. This Act takes effect September 1, 2003, and applies only to an election ordered on or after that date.
