A BILL TO BE ENTITLED

AN ACT

relating to the Texas Education Agency's use of certain unexpended 
funds from the optional extended year program.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 29.082, Education Code, is amended by 
adding Subsection (h) to read as follows:
	(h)  A school district that receives funding from the agency 
based on an application submitted under this section shall at the 
end of the extended year program's fiscal year return any of those 
unexpended funds to the agency.  The agency shall use the unexpended 
funds for high school summer school programs during the summer 
following the return of the funds.
	SECTION 2.  This Act takes effect September 1, 2003.
