A BILL TO BE ENTITLED

AN ACT

relating to stating the amount of a franchise fee for the provision 
of electric energy services on a customer's bill.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 33.008, Utilities Code, is amended by 
adding Subsection (i) to read as follows:
	(i)  A retail electric provider that pays a franchise fee 
under this section as part of a nonbypassable delivery fee and 
passes the charge through to its customers shall list the amount of 
the fee applicable to a customer as a separate line item on the 
customer's bill for electric energy services.
	SECTION 2.  This Act takes effect September 1, 2003, and 
applies to a bill for electric energy services sent to a customer on 
or after that date.  A bill for electric energy services sent to a 
customer before that date is governed by the law in effect on the 
date the bill was sent, and that law is continued in effect for that 
purpose.
