A BILL TO BE ENTITLED
AN ACT
relating to involuntary separation of fire fighters from employment
in certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.1115, Local Government Code, is
amended by adding Subsection (g) to read as follows:
(g) A fire fighter who suffers a line of duty illness or
injury and who, because of the illness or injury, is determined
under the procedure outlined in this section to be unable to perform
the duties or assignments of the fire fighter's classified position
may not be involuntarily separated from employment in the
classified service for a medical reason related to the illness or
injury if there is any other position within the fire fighter's
employing fire department the duties of which the fire fighter is
capable of performing.
SECTION 2. This Act takes effect September 1, 2003.
