A BILL TO BE ENTITLED
AN ACT
relating to a telephone dating service; providing a criminal penalty. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter D, Chapter 35, Business & Commerce Code, is amended by adding Section 35.58 to read as follows: Sec. 35.58. TELEPHONE DATING SERVICE. (a) In this section, "telephone dating service" means a service provided by or through the use of the telephone to arrange or facilitate the social introduction of two persons for the purpose of promoting the meeting of compatible individuals. The term includes a personal introduction service, a compatibility matching service, or an escort service. (b) A person commits an offense if the person enters into an agreement to provide telephone dating services to an individual for a fee or other consideration without verifying that the individual is 18 years of age or older. (c) An offense under this section is a Class B misdemeanor. SECTION 2. This Act takes effect September 1, 2003, and applies only to an agreement entered into on or after that date.
