A BILL TO BE ENTITLED

AN ACT

relating to standards for the construction or modification of an 
assisted living facility.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 247.0261, Health and Safety Code, is 
amended by adding Subsection (f) to read as follows:
	(f)  A person proposing to construct or modify an assisted 
living facility must ensure that the proposed construction or 
modification meets all life safety code requirements as specified 
in the 1988 edition of the National Fire Protection Association 
(NFPA) 101.  Type A and Type B assisted living facilities must 
conform to Chapter 21 of the 1988 edition of the National Fire 
Protection Association (NFPA) 101.
	SECTION 2.  This Act takes effect September 1, 2003, and 
applies only to building plans submitted to the Texas Department of 
Human Services on or after that date. Building plans submitted 
before the effective date of this Act are covered by the law in 
effect on the date the plans were submitted, and the former law is 
continued in effect for that purpose.
