A BILL TO BE ENTITLED
AN ACT
relating to the execution of an out-of-hospital do-not-resuscitate
order on behalf of a minor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 166.085, Health and Safety Code, is
amended to read as follows:
Sec. 166.085. EXECUTION OF OUT-OF-HOSPITAL DNR ORDER ON
BEHALF OF A MINOR. (a) The following persons may execute an
out-of-hospital DNR order on behalf of a minor:
(1) the minor's parents;
(2) the minor's legal guardian; or
(3) the minor's managing conservator.
(b) A person listed under Subsection (a) may not execute an
out-of-hospital DNR order unless the minor has been diagnosed by a
physician as suffering from a terminal or irreversible condition.
SECTION 2. This Act takes effect September 1, 2003.
