A BILL TO BE ENTITLED
AN ACT
relating to supplemental pay for certain officers commissioned by the Department of Public Safety. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. The heading to Section 411.016, Government Code, is amended to read as follows: Sec. 411.016. SUPPLEMENTAL PAY FOR OVERTIME HOURS WORKED OR PROJECTS FUNDED BY THE FEDERAL GOVERNMENT. SECTION 2. Subchapter A, Chapter 411, Government Code, is amended by adding Sections 411.0161 and 411.0162 to read as follows: Sec. 411.0161. SUPPLEMENTAL PAY FOR PROFICIENCY CERTIFICATION. (a) Subject to the availability of funds and except as provided by Subsection (d), an officer commissioned by the department who has been issued one of the following proficiency certificates by the Commission on Law Enforcement Officer Standards and Education is entitled to supplemental pay in the amount of: (1) $100 a month for an intermediate peace officer proficiency certificate or an equivalent certificate; (2) $200 a month for an advanced peace officer proficiency certificate or an equivalent certificate; or (3) $300 a month for a master peace officer proficiency certificate or an equivalent certificate. (b) If an officer has been issued more than one of the certificates described by Subsection (a), the officer is entitled only to the amount of supplemental pay attributable to the most advanced certificate issued to the officer. (c) An officer who is entitled to supplemental pay under this section is entitled to that pay in addition to the officer's regular compensation for as long as the proficiency certification is in effect. (d) An officer who receives supplemental pay under this section may not receive supplemental pay for obtaining a higher education degree under Section 411.0162. Sec. 411.0162. SUPPLEMENTAL PAY FOR OBTAINING HIGHER EDUCATION DEGREE. (a) Subject to the availability of funds and except as provided by Subsection (c), an officer commissioned by the department who has obtained one of the following degrees from an accredited public or private college or university is entitled to supplemental pay in the amount of: (1) $100 a month for an associate's degree; (2) $200 a month for a bachelor's degree; or (3) $300 a month for a master's degree or more advanced degree. (b) If an officer has obtained more than one of the degrees described by Subsection (a), the officer is entitled only to the amount of supplemental pay attributable to the most advanced degree obtained by the officer. (c) An officer who receives supplemental pay under this section may not receive supplemental pay for proficiency certification under Section 411.0161. SECTION 3. This Act takes effect September 1, 2003.
