A BILL TO BE ENTITLED
AN ACT
relating to certain highway access rules of the Texas Transportation Commission. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 203, Transportation Code, is amended by adding Section 203.0311 to read as follows: Sec. 203.311. CHANGES TO CERTAIN HIGHWAY ACCESS RULES PROHIBITED. (a) In this section "development project" means: (1) the subdivision of land; (2) the construction, reconstruction, redevelopment, conversion, structural alteration, relocation, or enlargement of any structure; or (3) any change in use or extension of the use of land. (b) This section applies only to a development project that: (1) was in progress on January 1, 2003, or commenced on or after that date; and (2) is subject to a highway access rules of the commission on the date that the owner of the development project incurs costs relating to the project. (c) The commission may not adopt or enforce a new highway access rules, an amendment of the existing rules, or the repeal of rules, if the new or amended rules, or the repeal of the existing rules, materially affects the highway access of the development project. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
