A BILL TO BE ENTITLED

AN ACT

relating to the violation of certain municipal solid waste 
regulations.     
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 361.024 Health and Safety 
Code, is amended by adding subsection (f) to read as follows:
	(f)  If a facility is found to be in violation of rules 
adopted by the commission pursuant to this section, the commission 
shall determine what enforcement action is necessary.  Notice of 
enforcement action shall be provided to the operator of the 
offending facility within 30 days and enforcement shall begin no 
later than 90 days from the day the violation is discovered.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
