A BILL TO BE ENTITLED
AN ACT
relating to limits on the compensation and employment of school
district administrators.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter I, Chapter 21, Education Code, is
amended by adding Section 21.4031 to read as follows:
Sec. 21.4031. LIMIT ON ADMINISTRATOR COMPENSATION. A
school district may not pay an administrator compensation that
exceeds five times the lowest amount of compensation the district
pays a classroom teacher.
SECTION 2. Subchapter D, Chapter 42, Education Code, is
amended by adding Section 42.202 to read as follows:
Sec. 42.202. LIMIT ON ADMINISTRATOR EMPLOYMENT. (a) A
school district may not employ a number of administrators that
exceeds a ratio of one administrator for each 12 teachers employed
by the district.
(a-1) Notwithstanding Subsection (a), for the 2003-2004,
2004-2005, and 2005-2006 school years, a school district may not
employ a number of administrators that exceeds a ratio of one
administrator for each 11 teachers employed by the district. This
subsection expires September 1, 2007.
(b) For purposes of this section:
(1) an administrator who teaches one or more classes
is counted as one-half an administrator and is not counted as a
teacher; and
(2) a counselor or librarian is not counted as either a
teacher or an administrator.
SECTION 3. This Act applies beginning with the 2003-2004
school year.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
