A BILL TO BE ENTITLED
AN ACT
relating to the recommendation and notice of termination or suspension without pay for certain school employees. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 21, Education Code, is amended by adding Subchapter N to read as follows:
SUBCHAPTER N. EDUCATIONAL SUPPORT PERSONNEL
Sec. 21.701. RECOMMENDATION. Before the employment of an educational support employee may be terminated or suspended without pay, the supervisor shall recommend such action in writing, including all reasons for the action, to the superintendent. Sec. 21.702. NOTICE. If the superintendent receives a recommendation from a supervisor for the termination or suspension without pay of an educational support employee, the superintendent after consideration of the written reason(s) required by Section 21.701, shall either reject the recommendation or concur. If the superintendent concurs with the recommendation, the employee shall be given a written copy of the notice and the reason(s) supporting the decision. SECTION 2. This Act applies beginning with the 2003-2004 school year. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
