A BILL TO BE ENTITLED
AN ACT
relating to accreditation of public school districts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 39.073, Texas Education Code, is amended by adding a new subsection (g) to read as follows: (g) Notwithstanding any other provision of law, the performance on any academic excellence indicators of students who are confined by court order in a residential program or facility operated by, or under a contract with, the Texas Youth Commission or other governmental entity shall not be considered in determining the accreditation status of the district within which such program or facility is physically located, nor in determining the district's performance in relation to the standards adopted for each academic excellence indicator. The performance of such students on any assessment instrument or other academic excellence indicators adopted by the state shall be determined and reported separately from the determination and report of the district within which the program or facility is physically located. SECTION 2. This Act applies beginning with the 2003–2004 school year. SECTION 3. This Act takes effect September 1, 2003.
