A BILL TO BE ENTITLED
AN ACT
relating to the administration of a polygraph examination to a peace officer. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 614.063, Government Code, is amended by adding Subsection (f) to read as follows: (f) The head of a law enforcement organization that employs or appoints a peace officer may be removed from office or employment if the head of the law enforcement organization: (1) suspends, discharges, or otherwise discriminates against a peace officer for refusing to submit to a polygraph examination that is not authorized under Subsection (a); or (2) requires a peace officer to submit to a polygraph examination under Subsection (e) without providing to the peace officer the written explanation required by that subsection. SECTION 2. This Act takes effect September 1, 2003, and applies only to an action taken by a head of a law enforcement organization against a peace officer on or after that date.
