A BILL TO BE ENTITLED
AN ACT
relating to the collection of ethnicity information from Asian
applicants for admission to a public institution of higher
education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 51.762(g), Education Code, is amended to
read as follows:
(g) In addition to other information considered appropriate
by the board, the board shall by rule require each institution to
collect information regarding gender, ethnicity, and date of birth
as part of the application process and report this information to
the board. Rules under this subsection must require each
institution to collect and report ethnicity information for
applicants of Asian descent according to the following subgroups:
(1) Central Asian/Russian;
(2) Southwest Asian;
(3) South Asian;
(4) East Asian; or
(5) Southeast Asian/Pacific Islander.
SECTION 2. The change in law made by this Act applies
beginning with admissions for the 2004-2005 academic year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
