A BILL TO BE ENTITLED
AN ACT
relating to permissible conditions of community supervision for certain defendants convicted of an alcohol-related offense. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 11, Article 42.12, Code of Criminal Procedure, is amended by adding Subsection (i) to read as follows: (i) A judge who grants community supervision to a person convicted of an offense under Chapter 49, Penal Code, other than an offense under Section 49.02 or 49.031, Penal Code, may require the person to pay an amount not to exceed $500 in one payment or in periodic installments, as considered appropriate by the judge, to a trauma facility owned or operated by a political subdivision of this state. SECTION 2. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. An offense committed before the effective date of this Act is covered by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. For purposes of this subsection, an offense was committed before the effective date of this Act if any element of the offense was committed before that date.
