A BILL TO BE ENTITLED

AN ACT

relating to recovery of an overpayment to a physician or provider by 
an insurer.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Article 3.70-3C, Insurance Code, as added by 
Chapter 1024, Acts of the 75th Legislature, Regular Session, 1997, 
is amended by adding the following new Section 10.
	Section 10.  An insurer may recover an overpayment to a 
physician or provider if, not later than one year after the date the 
physician or provider receives the payment, the insurer provides 
written notice of the overpayment to the physician or provider that 
includes the basis and specific reasons for the request for 
recovery of funds.
	SECTION 2.  This Act takes effect September 1, 2003.
