A BILL TO BE ENTITLED
AN ACT
relating to the authority of the commissioner of education to waive certain monitoring or reporting requirements. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 7.056, Education Code, is amended by adding Subsection (h) to read as follows: (h) Notwithstanding any other provision of this section or other law, the commissioner may waive any state law or rule to the extent that the law or rule imposes a more strenuous reporting or monitoring requirement on a school district than the reporting or monitoring that is required by federal law, rule, or regulation applicable to the subject matter of the state law or rule. Nothing in this subsection should be construed to allow the commissioner to waive any law or rule when such waiver would jeopardize the health, safety, or welfare of a child. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
